Ordinance on Biocidal Products
Conformity with the Ordinance on Biocidal Products (OBP, SR 813.12)
In Switzerland, disinfectants need to be approved, notified or recognized in accordance with the Ordinance on Biocidal Products (OBP, SR 813.12) before they are placed on the market or used for commercial or professional purposes.
The Swiss Ordinance on Biocidal Products regulates the production, the placing on the market as well as the use of biocidal products. In the OBP, the authorisation procedure for a biocide is stated in a precise, clear manner and step by step, starting with the request for approval of the active agent right to the authorisation, packaging and marketing of the product. Moreover, the OBP regulates the placing on the market of biocidal products during the transition period, i.e. when the active substances have been notified but not yet approved. The OBP is largely harmonised with the EU Regulation No. 528/2012 and is continuously being revised.
Purolyt was approved for the use by private and professional users according to the Ordinance on Biocidal Products (OBP, SR 813.12) by the Swiss Federal Office of Public Health with the federal authorisation number CHZN5403. The authorisation holder is the Ramotra GmbH.
Conformity with Article 62d OBP or the "Article 95 List"
With the latest revision of the Ordinance on Biocidal Products (OBP; SR 813.12), intellectual property protection for active substance (research) data is now also regulated in Switzerland. In accordance with the relevant provisions of the EU Biocidal Products Regulation (BPR), such products may only be marketed if their active substances come from listed suppliers. Article 95 BPR stipulates that companies which until now did not participate in notification procedures for active agents shall contribute towards the costs of the notification procedure for active agents (prevention of “free riders”) and that all relevant parties shall assume according financial responsibilities. This BPR-concept of equal treatment of persons which place active agents and biocidal products on the market is implemented in Switzerland with article 62d OBP. As a consequence, with effect from 1 September 2016, biocidal products can only be placed on the market in Switzerland if - for the active substance contained in or generated by the biocidal product - the substance or product supplier is included in the Article 95 List issued by the ECHA. Thus, we are able to provide evidence that we only use raw materials sourced from suppliers listed on the ECHA “Article 95 List”.
